MAYOR DWYER – THE MICROPHONES ARE BACK OPERATIONAL.  WE HAVE A GUEST HERE, MICHAEL JONDROW, WHO IS THE EXECUTIVE DIRECTOR OF THE WARWICK CHAMBER OF COMMERCE, WHO HAS A BRIEF PRESENTATION. 

 

PRESENTATION BY MICHAEL JONDROW OF THE WARWICK CHAMBER OF COMMERCE CONCERNING TOURISM AND BRINGING IN VISITORS TO THE WARWICK VALLEY BY PROMOTING IT AS A FOUR SEASON COMMUNITY.    

 

MAYOR DWYER – IF YOU ARE LOOKING FOR SPRING ACTIVITIES, HIKING THE APPALACHIAN TRAIL IS A GREAT ONE.

 

TINIE FILIPOWSKI – ALSO THE EAST ARM ROWING CLUB, FISHING AND ICE FISHING AS WELL.

 

MAYOR DWYER – I LIKE THE EFFORT OF PROMOTING FOUR SEASONS, BECAUSE WE DO HAVE ACTIVITIES FOR ALL FOUR AND I’TS GREAT THAT ALL THE VILLAGES AND TOWN WORK TOGETHER TO PROMOTE TOURISM. 

 

MAYOR DWYER – THERE IS NO CORRESPONDENCE, OR DEPARTMENT HEAD REPORTS OR VISITING ELECTED OFFICIALS.

 

TRUSTEE ENGLISH – WE DID OUR PLANTING FOR THE VILLAGE PLANTERS AND HANGING BASKETS.  THIS YEAR WE RETURNED TO AN ORIGINAL CONCEPT BY HAVING THE GIRL SCOUTS ADOPT A PLANTER AND TAKE CARE OF IT ALL SUMMER.  THEY CAME OUT TO HELP PLANT ALL THE PLANTS THIS PAST WEEKEND IN THE SQUARE PLANTERS AND THE HANGING BASKETS.  TO SAVE THE VILLAGE SOME MONEY, WE WENT TO A LOCAL VILLAGE GROWER TO BUY OUR FLOWERS, TECHNIGROWERS, WHICH WORKS THROUGH THE GENERALS GARDEN IN WARWICK.  WE ALSO ORDERED ANNUALS FROM THE GREENWOOD LAKE GARDEN CENTER FOR THE WINDOW BOXES OUTSIDE OF VILLAGE HALL AND AT THE POLICE STATION AND AT THE GAZEBO ON WATERSTONE ROAD.  I WANT TO THANK SUE TOSCANO WHO HELPED TO ORGANIZE THIS ALONG WITH ALL OF THE LEADERS THAT CAME OUT AND ALL THE GIRL SCOUTS, WHICH WERE BETWEEN 50 AND 60 GIRLS, THAT HELPED TO PLANT EVERYTHING.  THEY LOVED IT AND HAD A GREAT TIME, AND ARE ALL WILLING TO COME BACK AGAIN NEXT YEAR.  THEY ARE READY WILLING AND ABLE TO VOLUNTEER THEIR TIME.  PLEASE STOP AND ADMIRE THE PLANTERS, I CAN’T THANK THE GIRL SCOUTS ENOUGH. 

 

TRUSTEE HOLDER – JUST A REMINDER THAT TOMORROW IS THE SCHOOL BUDGET VOTE AND BOARD OF EDUCATION MEMBERS VOTE AT THE ELEMENTARY SCHOOL FROM 11:00AM TO 9:OOPM SO GO OUT AND VOTE.  GRANDPARENTS DAY IS ALSO TOMORROW IN THE ELEMENTARY SCHOOL GYM AT 10:00AM. 

 

MAYOR DWYER – TRUSTEE HOWLEY IS NOT HERE TONIGHT, HE GOT STUCK IN THE CITY. 

 

TRUSTEE KELM – I HAVE NO REPORT TONIGHT.

 

ATTORNEY REPORT – JOHN BUCKHEIT STATED I SPENT MOST OF THIS AFTERNOON AT THE NEW YORK STATE ATTORNEY GENERAL’S OFFICE AT THE OFFICE OF ETHICS IN GOVERNMENT.  I BROUGHT DOWN THE DOCUMENTS THE CLERKS HAD PREPARED AND BATE STAMPED IN RESPONSE TO THE SUBPOENA WE RECEIVED WITH REGARDS TO THE LIBRARY PROJECT AND VILLAGE HALL IMPROVEMENTS.  I INDICATED TO THEM THAT IN APPROXIMATELY 30 DAYS I WILL DELIVER THE REMAINDER OF THE DOCUMENTS.  I HAVE BEEN INTERACTING WITH ASSEMBLYWOMAN RABBITT’S OFFICE REGARDING THE DEC.  WE ARE ASKING THEM TO TALK TO THE DEC WITH REGARDS TO THE SPEDES PERMITS TO INTERCEDE AND ASK FOR LENIENCY REGARDING FINES.  I HAVE BEEN UP IN WAH TA WAH REGARDING THE FORMER BETHUNE PROPERTY WHICH HAS A SEPTIC TANK SITTING ON THE LAWN.  WE WERE IN COURT LAST MONTH AND INDICATED TO HIM WE WERE GOING TO KEEP PURSUING THIS MATTER AND HE STATED HE COULDN’T AFFORD TO DO SO, BUT WE WILL KEEP ON IT.  WE ALSO HAD DISCUSSIONS WITH THE COUNTY ATTORNEY ON A PIECE OF PROPERTY WHICH HAS A STORAGE UNIT ON IT.  THE COUNTY IS STATING THEY OWN THE PROPERTY BUT DO NOT TAKE OWNERSHIP OF ANYTHING ON IT SUCH AS THE STORAGE UNIT.  THEY HAVE NOTIFIED THE FORMER PROPERTY OWNER TO COME AND GET THE UNIT, OR THEY WILL PROSECUTE THEM.  WE WILL CONTINUE TO MONITOR THIS WITH THE COUNTY. 

 

MAYOR DWYER – WE APPRECIATE ALL OF YOUR HARD WORK. 

 

VILLAGE CLERK REPORT- PATRICIA OLSEN STATED WE ARE CURRENTLY FOLDING AND STUFFING THE TAX BILLS WHICH WILL BE OUT JUNE 1ST WITH THE HELP OF THE BUILDING DEPARTMENT CLERK PATTY, AND WE THANK HER FOR THAT.  WATER BILLS NOW HAVE A 10% PENALTY DUE.  IF YOU HAVE ANY CONCERN OR QUESTIONS REGARDING, POT HOLES, ETC. PLEASE CALL THE VILLAGE HALL.

 

MAYORS REPORT – I JUST WANT TO ECHO TRUSTEE ENGLISH’S COMMENTS ON THIS  PAST WEEKEND.  THERE ARE MANY TIMES WHEN LIVING IN A GREAT COMMUNITY, THAT YOU FIND YOURSELF STOPED IN  YOUR TRACKS, SMILING IN AMAZEMENT.  THIS PAST SATURDAY, I H AD ONE OF THOSE MOMENTS.  THIS PAST SATURDAY I WITNESSED YET ANOTHER TREMENDOUS ACT OF CIVIC ENGAGEMENT BY ONE OF OUR MANY LOCAL ORGANZIATISON- THE GREENWOOD LAKE GIRL SCOUTS.  THROUGHT THE COORDINATION AND EFFORTS OF GREENWOOD LAKE TRUSTEE EN ENGLISH AND GIRL SCOUT LEADER SUE TOSCANO, WE HAD NEARLY 60 GIRL SCOUTS AND DOZENS OF TROOP LEADERS AND PARENTS AT OUR DPW HARD AT WORK PLANTING AND PREPAIRNG OUR BOX PLANTERS AND HANGING BASKETS FOR THE SPRING SHOWING OF GREENWOOD LAKE FLOWERS.  THE GWL GIRL SCOUTS HAVE ADOPTED OUR BOX PLANTERS THROUGHOUT THE VILLAGE AND WILL BE RESPONSIBLE FOR WATCHING AFTER THEM AS THEY GROW.  WE AS MUNICIPAL LEADERS ARE NOT ONLY PROUD TO PROVIDE THE SCOUTS WITH THIS OPPORTUNITY, WE ARE LUCKY TO HAVE SUCH DEDICATED YOUTH IN THE COMMUNITY WHO ARE WILLING TO TAKE ON THIS RESPONSBILITY.  I WOULD LIKE TO SEND OUT A SPECIAL THANK YOU TO ALL OF THE GIRL SCOUT TROOP LEADERS AND PARENTS WHO HELPED MAKE THIS POSSIBLE, AS WELL AS TOM ANDERSON AND JOE PUZIO FOR THEIR HARD WORK AND DEDICATION IN GETTING EVERYTHGIN SET UP.  MOST IMPORTANTLY, THANK YOU TO ALL OF THE GIRL SCOUTS WHO SEE THE IMPORTANCE IN GIVING BACK TO OUR COMMUNITY AND HAVING THE COURAGE TO TAKE RESPONSBILITY OVER THE PLANTERS.  THE HARD WORK THAT TRUSTEE ENGLISH PUT INTO THAT WILL SHOW.  THE BOX PLANTERS ARE OUT.  THE HANGING BASKETS WILL BE UP THIS WEEK.  THEY ARE BEAUTIFUL AND I AM HAPPY THAT TRUSTEE ENGLISH WAS ABLE TO GET THESE ALL DONE WELL BELOW BUDGET.

SANITATION BIDS – WE OPENED THE BID RECENTLY.  THERE WAS ONLY ONE BIDDER AND IT WAS THE COMPANY THAT HAS BEEN DOING OUR SANITATION, IWS.  THEY HAVE DONE GREAT THINGS FOR US, INCLUDING PROVIDING TOTERS.  WE WERE HOPING TO SAVE SOME MONEY AND THEY DID COME IN AT A LOWER PRICE THAN THIS YEAR WHICH WILL SAVE US $16,500.  WE BUDGETED $291,000 AND THEREFORE WE WILL BE UNDERBUDGET IN THAT ACCOUNT BY $16500.00 AND WE THANK THEM FOR COMING IN AT A LOWER BID. 

 

ZBA REAPPOINTMENTS – ITS THAT TIME OF THE YEAR WHEN APPOINTMENTS FOR THE ZBA ARE UP.  ON APRIL 1ST I SENT A LETTER OUT TO THE THREE MEMBERS OF THE ZONING BOARD WHOSE TERMS ARE UP ON MAY 31, 2013.  THE LETTER READ “  YOUR APPOINTMENT TO THE GREENWOOD LAKE ZONING BOARD OF APPEALS IS EXPIRING ON MAY 31ST, 2013.  IF IT IS YOUR INTENTION TO SEEK REAPPOINMENT TO THE BOARD, PLEASE ADVISE ME BY WRITING NO LATER THAN MAY 17TH, 2013 AND IT IS SIGNED SINCERELY JESSE DWYER, MAYOR.  SINCE THAT TIME I RECEIVED TWO LETTERS REQUESTING REAPPOINTMENT.  ONE IS FROM VICTOR LUDMERER AND READS AS FOLLOWS:  DEAR JESSE, CONGRATULATIONS ON YOUR ELECTION AS MAYOR OF THE VILLAGE OF GREENWOOD LAKE.  THANK YOU FOR YOUR LETTER DATED APRIL 1ST 2013.  IF IT MEETS WITH YOUR APPROVAL AND THE APPROVAL OF THE VILLAGE TRUSTEES, I WILL BE PLEASED TO SERVE OUR VILLAGE AS A MEMBER OF THE GREENWOOD LAKE ZONING BOARD OF APPEALS FOR ANOTHER TERM.”  THE SECOND LETTER I RECEIVED READS:  DEAR MAYOR DWYER, I AM REQUESTING REAPPOINTMENT TO THE VILLAGE OF GREENWOOD LAKE’S ZONING BOARD OF APPEALS.   I HAVE ENCLOSED A CERTIFICATE OF COMPLETION FROM THE ORANGE COUNTY MUNICIPAL PLANNING FEDERATION STATING THAT I RECEIVED THE NECESSARY ANNUAL TRAINING REQUIRED FOR MUNICIPAL BOARDS.  THANK YOU FOR YOUR CONSIDERATION, SINCERELY FLOYD DEANGELO.  THERE WERE THREE VACANT SPOTS.  I WOULD LIKE TO SUGGEST WE APPOINT JOHN SORRENTINO TO THE THIRD SEAT.

BI-STATE LAKE COMMISSION – MAYOR DWYER STATED WE HAD TO FILL A SPOT ON THE BI STATE COMMISSION AS A LAKE REPRESENTATIVE.  WE WOULD LIKE TO APPOINT EDWARD KRULL TO FILL THIS APPOINTMENT. 

 

MOTIONED BY TRUSTEE  KELLI KELM.  SECONDED BY TRUSTEE HOLDER.  ALL AYES, ONE ABSENT .

 

MAYOR DWYER – THAT FILLS ALL THE NEEDED APPOINTMENTS FOR THE YEAR. 

 

AERATION/BIOLOGICALS –WE HAVE AN AERATION SYSTEM IN PLACE THAT REQUIRES MULTIPLE THINGS TO BE OPERATIONAL, SUCH AS BUBBLERS, AND ORGANICS AND BIOLOGICALS THAT EAT THE SEDIMENT.  LAST YEAR THE BOARD DECIDED TO TURN OFF THE AERATORS FOR THE WINTER SEASON, TO SAVE THE WILDLIFE AND PROMOTE TOURISM IN KEEPING THIS LAKE SAFE.  ONE OF THE CONSEQUENCES WE WERE TOLD MAY ARRIVE IS THAT WE WOULD NEED TO ADD MORE BIOLOGICAL AGENTS IN THE SPRING OR SUMMER.  I FELT AS A TRUSTEE AT THE TIME THAT WE HAD TO SHUT THEM DOWN.  WE REALIZED WE WOULD SAVE APPROXIMATELY $2000 ON ELECTRIC IF WE DID THIS.  I RECEIVED A LETTER FROM JOHN TUCCI WHICH STATED HE WAS IN TOWN AND CHECKED THE AERATION SYSTEMS.  SOME OF THE AERATORS ARE DOWN FROM THE STORM.  SINCE THEN ROY PETERSON HAS FIXED THE ELECTRICAL AND WE ARE JUST WAITING FOR ORANGE AND ROCKLAND TO INSPECT THEM AND THEN THEY WILL ALL BE BACK UP.  MR. TUCCI RECOMMENDS BIOLOGICALS TO BE ADDED WHERE THE SYSTEM WAS OFF DUE TO THE POWER OUTAGE AND NEAR THE GAZEBO AREA, NORTH OF THE 17AREA BRIDGE AND UPPER WEST SIDE NEAR THE INLET THAT STILL HAVE MUCK AND WEED PROBLEM.  IF WE PUT ALL THE BIOLOGICALS THEY ARE SUGGESTING IN IT WILL COST THE VILLAGE $2,310.  IF LESS FUNDS ARE AVAILABLE THEY ARE RECOMMENDING AN ALTERNATIVE TREATMENT OF $1080.00. 

 

MAYOR DWYER – I AM NOT MAKING THAT DECISION WITHOUT THE VILLAGE BOARD KNOWING.  WE MADE THE DECISION TO SHUT THEM OFF KNOWING WE MIGHT HAVE TO ADD BIOLOGICALS.  I GUESS THE QUESTION IS HOW MUCH DO WE WANT TO SPEND ON THIS.  MY THOUGHT IS WE ARE INVESTING IN SOMETHING, WE NEED TO MAINTAIN THE INVESTMENT.  WE DIDN’T BUDGET ANYTHING FOR BIOLOGICALS.  WE ARE OVERBUDGET IN MANY AREAS OF THE BUDGET THIS YEAR.  JUST BECAUSE WE HAD A SAVINGS IN ELECTRICITY, DOESN’T MEAN WE CAN PUT THAT TOWARDS EVERYTHING WE WANT.  I THINK WE CAN SQUEEZE THE MONEY OUT OF SOMEWHERE TO PAY FOR THIS. 

 

TRUSTEE KELM – WHAT HAPPENED BETWEEN YOUR PHONE CONVERSATION WITH HIM SAYING HE TESTED THE SYSTEM AND EVERYTHING LOOKED FINE.  NOW HE IS SAYING HE DID ANOTHER TEST AND WE NEED TO APPLY BIOLOGICALS.  I AM A LITTLE CONFUSED HERE. 

 

MAYOR DWYER – WHEN I FIRST SPOKE WITH HIM IT WAS THE MIDDLE OF APRIL AND STILL COLD.  NOW THE WEEDS ARE COMING UP. 

 

TRUSTEE KELM – ACCORDING TO MR. TUCCI WE NEED TO APPLY THE BIOLOGICALS WHERE THE SYSTEMS WERE OFF BECAUSE OF THE POWER SITUATION. 

 

MAYOR DWYER – AND OBVIOUSLY WE HAVE A MAJOR PROBLEM ON THE SIDE OF 17A WHICH LOOKS LIKE IT IS TURNING INTO A FIELD SOON.  I DON’T THINK THAT BIOLOGICALS OR AERATION IS GOING TO HELP OVER THERE.  I WOULD RECOMMEND PUTTING IN A TOTAL APPLICATION, MONITORING THE SYSTEM.  WE HAVE A FIVE YEAR CONTRACT WITH THIS COMPANY AND TWO YEARS TO GO.  WE FINISH THE INVESTMENT WE HAVE ALREADY CONTRACTED FOR.  WE OWE $30,000 ON THE LEASE THIS YEAR, PLUS ELECTRIC BILLS AND BIOLOGICALS.  IF WE ARE GOING TO GO AHEAD, I WOULD RECOMMEND WE CONTINUE WHAT WE HAVE BEEN DOING AND GIVE IT THE TWO YEARS THAT ARE LEFT IN THE CONTRACT AND SEE HOW EVERYTHING PERFORMS.  AT THE END THE SUMMER I BELIEVE WE NEED TO DISCUSS HOW EFFECTIVE THEY ACTUALLY ARE. 

 

TRUSTEE ED ENGLISH – WHO WAS WITH JOHN TUCCI WHEN HE AND HIS CREW CAME THROUGH?

 

MAYOR DWYER – I DON’T KNOW. 

 

TRUSTEE ENGLISH – SO NO ONE ON THE BOARD WAS NOTIFIED HE WAS COMING OR THAT HE WAS HERE?

 

MAYOR DWYER – NOPE. I AM VERY DISAPPOINTED THAT I HAVE NEVER MET HIM OR A REPRESENTATIVE OF HIS COMPANY AND THAT HE CAME TO THE VILLAGE AND DID NOT NOTIFY US OR THE BOARD OR THE CLERK THE COURTESY OF A PHONE CALL TO INFORM US THAT HE WAS IN TOWN.  I WOULD HAVE LOVED TO BE PRESENT TO ASK QUESTIONS, BUT I WASN’T GIVEN THAT COURTESY.  I’M UNAWARE OF WHO WAS WITH HIM THAT DAY. 

 

TRUSTEE ENGLISH – SINCE I AM NEW TO THE BOARD, I WOULD LIKE HIM TO COME TO THE BOARD TO GIVE US SOME BACK UP FOR THIS LETTER HE SENT US.

 

MAYOR DWYER – I WOULD ENCOURAGE THAT AS WELL, SO WE WILL ASK HIM TO COME FOR THE NEXT BOARD MEETING. 

 

TRUSTEE ENGLISH – I AGREE THAT WE HAVE THIS SYSTEM AND WE WANT IT TO BE RUNNING AS EFFECTIVE AS POSSIBLE TO SEE IF IT WILL PERFORM TO WHAT THE EXPECTATIONS ARE SUPPOSED TO BE. 

 

TRUSTEE KELM – I WOULD LIKE TO KNOW WHAT HAPPENED BETWEEN THE BEGINNING OF THE MONTH WHEN HE TOLD YOU THE LAKE WAS FINE FOR THE YEAR WITHOUT BIOLOGICALS, AND NOW WE NEED THEM.  THAT’S A COMPLETE CHANGE IN LESS THAN A MONTH.  I’M NOT AGAINST ADDING THEM, I JUST DON’T UNDERSTAND WHAT CHANGED AFTER THE INITIAL TESTING.  YOU CAME AND DID TESTS, YOU DIDN’T NOTIFY US THAT YOU WERE EVEN DOING THEM.  YOU CALLED THE MAYOR AND SAID IT WAS FINE AND NOW YOU WRITE AND SAY ITS NOT. 

 

MAYOR DWYER – EVERYONE IS IN AGREEMENT THAT WE ASK HIM TO COME TO THE NEXT MEETING ON JUNE 3RD

 

TRUSTEE HOLDER – I WANT TO KNOW THE DIFFERENCE BETWEEN THE TWO PRICES, WHAT WOULD THE EFFECT BE. 

 

MAYOR DWYER – THERE ARE DIFFERENT PRICES FOR DIFFERENT THINGS.  I WOULD ASSUME THE DIFFERENCE WOULD BE THE EFFECTIVENESS OF THE TREATMENT.  WE WANT TO REDUCE THE AMOUNT OF THE SEDIMENT AS QUICKLY AS POSSIBLE.  IF WE ARE ONLY GOING TO DO THIS HALFWAY AND HAVE IT TAKE TWICE AS LONG, WHY EVEN BOTHER.  THESE ARE ALL CERTAINLY QUESTIONS THAT WE NEED TO ASK THEM. 

 

TRUSTEE HOLDER – DO WE HAVE ANY DOCUMENTATION FROM WHEN WE STARTED USING THESE AERATORS UNTIL NOW THAT IT IS MAKING A DIFFERENCE?

 

MAYOR DWYER – NO, AND ONE OF THE THINGS THAT I UNCOVERED IS THAT THE DEC REQUIRES US TO SUBMIT ANNUAL REPORTS ON THE PROGRESS OF THIS SYSTEM AND WE HAVE NEVER SUBMITTED ONE OF THOSE REPORTS IN THE THREE YEARS THE SYSTEM HAS BEEN OPERATING.  WE DON’T HAVE ANY DOCUMENTATION AS TO THE PROGRESS OF THE AERATORS.  WHEN I SPOKE TO JOHN TUCCI, I TOLD HIM I  AM MAKING IT A REQUIREMENT THAT WE HAVE DOCUMENTED PROGRESS OF THIS SYSTEM. 

 

TRUSTEE KELM – IS HE DOCUMENTING THE PROGRESS?  CAN WE GET COPIES OF THOSE DOCUMENTS. 

 

MAYOR DWYER – I HOPE SO.  HE DID DO A PRESENTATION FOR US LAST YEAR WHICH BASICALLY SHOWED IMAGES, BUT WE DON’T HAVE ANY INFORMATION ON DEPTH TESTS, SEDIMENT, ETC.  THERE ARE NO IMAGES OF THE ACTUAL BOTTOM OF THE LAKE.  WHEN I SPOKE TO THE DEC THEY WE WERE SUPPOSED TO SUBMIT REPORT EACH AND EVERY YEAR AND HAVE NOT DONE IT.  IF WE HAD BEEN SUBMITTING THOSE REPORTS WE COULD MAKE A DECISION HERE MUCH MORE EASILY.  I HAVE ENCOURAGED HIM TO TAKE BETTER DOCUMENTATION AND RECORDS WHILE HE IS HERE SO THAT THE BOARD CAN HAVE ALL THE AVAILABLE FACTS HERE WHEN WE NEED TO MAKE A DECISION.  WE CAN WAIT UNTIL THE JUNE 3RD MEETING, WE CAN DO THAT.  I WILL CALL HIM AND LET HIM KNOW WE WANT TO WAIT UNTIL JUNE 3RD AND WE WANT TO ASK SOME QUESTIONS AND WE WILL SEE WHAT HE SAYS.

HUD –  MAYOR DWYER STATED WE HAD A PUBLIC HEARING EARLIER TONIGHT AND THE PROJECT AT THE WATERSTONE GAZEBO CAME UP.  COMMUNITY DEVELOPMENT HAS APPROVED A PROJECT THERE TO MAKE IT MORE HANDICAPPED ACCESSIBLE IN THE AMOUNT OF $25,000 AND THE VILLAGE WOULD BE RESPONSIBLE FOR ALL ENGINEERING FEES WHICH WOULD BE APPROXIMATELY $10,000 – $12,000.  IS THIS SOMETHING THAT WE WANT TO INVEST THAT MUCH MONEY IN A COMMUNITY PROJECT.   ALTHOUGH IT’S GREAT TO GET THIS GRANT, WE HAVE TO MATCH IT AT ALMOST 50% AND I DON’T KNOW IF WE WANT TO SPEND IT.  IT’S A WONDERFUL IDEA BUT AS A BOARD WE HAVE TO DECIDE IF WE WANT TO SPEND OUR LIMITED RESOURCES ON IT.  THERE IS A DRAWING DEPICTING THE PROJECT WHICH DEPICTS THE PARKING SPACES, AND A POROUS PAVER SIDEWALK THAT GOES RIGHT DOWNHILL TO THE LAKE, WHICH IS  A LITTLE STRANGE.  THEY WOULD FIX THE RAILING.  WHICH IF NECESSARY WE CAN DO THAT OURSELVES.  TRUSTEE ENGLISH PLANTED THE BOXES DOWN THERE, AND PERHAPS WE CAN SPEND A LITTLE MONEY DOWN THERE AND FIX IT UP. 

 

TRUSTEE KELM – IT SEEMS LIKE A LOT OF MONEY TO SPEND ON ENGINEERING FEES FOR  LITTLE PROJECT LIKE THIS.  MAYBE THERE WON’T BE POROUS PAVERS THERE, BUT WE CAN MAKE IT HANDICAP ACCESSIBLE. 

 

MAYOR DWYER – ALSO THE PROJECT IS OVER $20,000 WE WOULD HAVE TO GO OUT TO BID WHICH TAKES TIME AND CAUSES A LOT OF WORK FOR OUR CLERKS.  WE HAVE VALUABLE RESOURCES THAT COULD BE SPENT ELSEWHERE. 

 

TRUSTEE KELM – I THINK WE SHOULD SKIP THIS PROJECT, DO SOME WORK DOWN THERE WITH OUR OWN PEOPLE AND FIX IT UP.

 

TRUSTEE ENGLISH – I COULD TELL YOU FROM WORKING DOWN AT THE DPW YARD THAT THERE ARE ABOUT 4 OR 5 FLATS OF PAVERS THAT ARE SITTING DOWN THERE COVERED BY A TARP FROM OLD PROJECTS THAT HAVE BEEN DONE.  MAYBE WE COULD GET SOME CIVIC MINDED VOLUNTEERS THAT KNOW SOMETHING ABOUT PAVERS TO HELP PUT A WALKWAY DOWN TO THAT WATER IN HOUSE.  THEY ARE FREE WE OWN THEM.  I WAS THINKING ALONG THIOSE LINES TO TAKE THIS PROJECT ON OURSELVES.

MAYOR DWYER – SO IT SEEMS WE ARE ALL IN AGREEMENT THAT WE ARE NOT GOING TO DO THIS PROJECT.  ALTHOUGH FREE MONEY IS GREAT, THE COST TO THE VILLAGE IS TOO LARGE.

DEC VIOLATION WATER TREATMENT PLANT BULK STORAGE- MAYOR DWYER STATED WE RECEIVED A LETTER, A NOTICE OF VIOLATION DATED FEBRUARY 8TH,2013 ABOUT CHEMICAL BULK STORAGE AND NOT HAVING THE PLAN IN PLACE IF A CHEMICAL SPILL WERE TO OCCUR.

 

TRUSTEE KELM- WAIT WE RECEIVED THAT IN FEBRUARY?  THIS IS THE FIRST I AM HEARING ABOUT IT.

 

MAYOR DWYER – THIS IS INTERESTING.  I PHOTOCOPIED THIS WHEN I GOT IT AND PUT IT IN EVERY TRUSTEE’S BOX A COUPLE OF WEEKS AGO. 

 

TRUSTEE KELM – I GOT THAT, BUT NOTHING IN FEBRUARY.

 

MAYOR DWYER – I GOT NOTHING IN FEBRUARY EITHER, THAT IS WHY THIS TIME I PUT ONE IN EVERY TRUSTEE’S BOX.  THIS IS A NOTICE OF VIOLATION.  AT THE TIME OF THE INSPECTION, WE WERE NOT IN COMPLIANCE BY HAVING A SPILL PREVENTION PLAN ON FILE.  WE DID NOT HAVE THE BULK STORAGE REQUIREMENTS THAT THE DEC REQUIRES AT OUR WATER FILTRATION PLANT, WHICH WE JUST SPENT 2 MILLION DOLLARS ON TO UPGRADE.  SINCE THEN, WE HAVE COMPLIED WITH ALL OF THEIR REQUIREMENTS.  WE HAVE CHANGED OUR BULK STORAGE PLAN AND THE STORAGE ITSELF AND DIVIDED THE STORAGE INTO TWO.  THE DEC IS STILL GOING TO FINE US APPROXIMATELY ANYWHERE FROM $2000 TO $25,000 BECAUSE AT THAT TIME WE WERE NON COMPLIANT.  THEY DO WANT US TO GO TO A HEARING AND EXPLAIN WHY WE WERE NOT IN COMPLIANCE AT THAT TIME.  I HAVE TALKED TO THE DEC AND TO THE WATER CONSULTANTS AND ASSEMBLYWOMAN ANNIE RABBITT AND OUR STATE SENATOR JOHN BONACIC TO HELP RELIEVE SOME OF THESE BURDENS.  HOPEFULLY WE WILL NOT HAVE TO PAY FOR THESE MISTAKES.  I JUST WANT TO KEEP THE BOARD INFORMED.  WE ARE NO LONGER IN VIOLATION, BUT WE POTENTIALLY MAY HAVE TO PAY A FINE FOR NOT BEING IN COMPLIANCE AT THE TIME.

MAYOR DWYER – WE HAVE ADDRESSED IT NOW, I DON’T KNOW WHY IT WASN’T DONE THEN, I WASN’T MAYOR AT THE TIME AND DIDN’T KNOW ABOUT IT.  MAYOR MOORE DID MAKE THE CHANGES AFTER SHE RECEIVED THE V IOLATION BUT THE FACT THAT THIS WAS AN OVERSIGHT, WITH A CONSULTING FIRM, ENGINEERS, MULTI MILLION DOLLAR UPGRADES, HOW WE WERE NOT COMPLYING WITH ALL THE DEC REGULATIONS IS BEYOND ME. 

 

TRUSTEE ENGLISH – WHY WERE LEHMAN AND GETZ NOT ON TOP OF THIS AS WELL AS TOM RUSSELL FROM THE WATER PLANT. 

 

MAYOR DWYER – I HAVE A MEETING WITH TOM AND LEHMAN AND GETZ TO DISCUSS THIS MATTER. 

 

TRUSTEE ENGLISH –PERHAPS IF THERE IS A FINE LEVIED, THESE TWO COMPANIES CAN HELP US OUT INSTEAD OF THE TAXPAYERS HAVING TO PAY FOR MISTAKES THAT WERE COVERED UP.

O&R IN WAH TA WAH-  IF YOU LIVE IN WAH TA WAH, SOME PARTS DO NOT HAVE NATURAL GAS, THEY HAVE TO USE PROPANE.   O & R IS LOOKING TO CONNECT WAH TA WAH TO NATURAL GAS STARTING WITH THE LOWER LEVELS.  WE MET WITH THEM BECAUSE WE HAVE BEEN DISSATISFIED WITH THEIR REPAIR WORK AFTER THEY CUT OUT THE ROADS AND PATCH IT.  WE MET WITH THE COMMISSIONER AND DEPUTY COMMISSIONER OF DPW AND ORANGE AND ROCKLAND AND TOLD THEM THE ONLY WAY THEY CAN DO THE PROJECT IS IF THEY PAVE THE ROADS.  THEY HAVE AGREED TO PAY THE EXPENSES FOR PAVING AS THEY GO.  THEY WILL MAKE MONEY, IT WILL BE COST EFFECTIVE FOR THE RESIDENTS, IT’S EASIER AND SAFER AND HOPEFULLY THAT IS THE GOAL.  WE JUST MAY HAVE FOUND A REALLY EASY WAY TO GET THE ROADS ALL REPAVED UP THERE.

MAYOR DWYER – I WAS ON THE COMPREHENSIVE PLAN COMMITTEE BEFORE I BECAME TRUSTEE AND I DID ADD THE COMPREHENSIVE PLAN COMMITTEE TO THE REORGANIZATION CHART.  I  HAVE BEEN TALKING TO A FEW PEOPLE AND CAN ASSURE YOU BY AUGUST OR SEPTEMBER WE SHOULD HAVE A NEW COMMITTEE.  THE LAST PLAN WAS DRAWN UP IN 1997 AND MANY, MANY THINGS HAVE CHANGED SINCE THEN. I THINK IT’S CRITICAL TO HAVE A NEW ONE. 

 

RESIDENT NORMAN WESTPHAL- I JUST WANT TO COMPLIMENT YOU ON THE REPAIR OF THE MICROPHONES.  AS A PERSON WHO HAS A HARD TIME HEARING, AND MOST MEETINGS I MISSED ABOUT 95% OF THE MEETING.  I COULD ACTUALLY HEAR EVERYONE TONIGHT SO CONGRATULATIONS.    ON THE POINT OF THE WATER TREATMENT PLANT, I WAS THINKING THE SAME THING AS MR. ENGLISH. IF WE HIRE A CONSULTING FIRM, A BIG FIRM, WHY DIDN’T THEY TELL THE DPW OR WHOEVER THAT THEY NEEDED TO COMPLY WITH ALL DEC REGULATIONS.  THEY SHOULD KNOW ALL OF THE REQUIREMENTS AND WE SHOULD HAVE BEEN NOTIFIED.  NOW WE GET FINED AFTER THE FACT AND THAT IS RIDICULOUS.  EITHER THEY KNEW IT AND DIDN’T TELL THE PLANT OPERATORS TO DO IT OR THEY DIDN’T GET A CHANCE.  NOW THEY FIXED IT BUT THE HORSE HAS ALREADY LEFT THE BARN.

THE VILLAGE OF GREENWOOD LAKE IS HERBY SUBMITTING ITS APPLICATION FOR CONSIDERATION UNDER THE FY-14 ORANGE URBAN COUNTY CONSORTIUM COMMUNITY DEVELOPMENT PROGRAM AND THAT THE CHIEF ELECTED OFFICIAL OR EXECUTIVE OFFICER IS HEREBY AUTHORIZED TO SUBMIT THIS APPLICATION.  THEY FURTHER CERTIFY THAT THEY HAVE READ AND UNDERSTOOD THE ORANGE URBAN COUNTY CONSORTIUM COMMUNITY DEVELOPMENT GUIDELINES FOR THE FY-2014 PROGRAM YEAR AND HAVE MET ALL OF ITS APPLICABLE REQUIREMENTS AND THAT THE INFORMATION CONTAINED IN THE APPLICATION IS ACCURATE AND TRUE TO THE BEST OF THEIR KNOWLEDGE.  THE VILLAGE OF GREENWOOD LAKE AND ITS LEGISLATIVE BODY IS ALSO IN SUPPORT OF SUBMITTING THE APPLCIATION ON BEHALF OF THE GREENWOOD LAKE FOOD PANTRY.

MAYOR DWYER – WE HAD A PUBLIC HEARING EARLIER ON HUD AND DISCUSSED THE FACT THAT THEY WILL NO LONGER BE GIVING US THE FOOD PANTRY GRANT, WHICH THE VILLAGE MATCHES.  I MET WITH MR. MAYFIELD LAST WEEK AND HE TOLD US THEY ARE NOT GOING TO BUDGET MONIES FOR FOOD PANTRIES ANYMORE.  THAT DAY I DRAFTED A LETTER TO MR. MAYFIELD URGING HIM TO RECONSIDER THEIR DECISION TO PULL THE FOOD PANTRY OUT OF THERE.  IT RELIES ON  GRANTS AND DONATIONS, AND HOPEFULLY THEY WILL RECONSIDER IT.  ATTORNEY BUCKHEIT SUGGESTED THAT WE SEND A LETTER TO ALL OF THE LOCAL ORGANIZATIONS LETTING THEM KNOW THAT THE FUNDING HAS BEEN PULLED.
